Your Rights in Foster Care

You have basic rights while you are in foster care that protect your general well-being. If your rights are violated, there are actions you can take to advocate for yourself.

Right to Participate in Your Permanency Planning Meeting

Your caseworker will develop a service plan for you and should talk to you about what should be in it. The service plan is sometimes called your Child’s Plan of Service or just your Child Plan. Your foster parent, caregiver, attorney, CASA, and relatives should be asked about what should be included in your service plan.

You should be given notice of any scheduled permanency plan meetings and can invite people you identify as family or supportive persons to attend; CPS must let you bring at least 2 people. You should be given a copy of the service plan. The plan should discuss where you live and how you are doing, your health and educational needs, what sort of structure you need at your placement, plans for getting you out of foster care and into a permanent home, and for preparing you for leaving foster care as you become an adult.
